Part A — Terms of Service

These Terms of Service ("Terms") govern your access to and use of T4G Pay, a digital payment platform operated by Howarig Traders (HT), a company registered in Papua New Guinea. By creating an account or using T4G Pay, you agree to be bound by these Terms.

1. Acceptance of Terms

By registering for a T4G Pay account, clicking "I agree", or otherwise accessing our services, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, you must not use T4G Pay.

2. Eligibility

To use T4G Pay you must:

• Be at least 18 years of age
• Be a resident of Papua New Guinea or a participating Pacific nation
• Have the legal capacity to enter into binding agreements
• Not be prohibited from using financial services under applicable law

By using T4G Pay you represent and warrant that you meet all eligibility requirements.

3. T4G Pay Services

T4G Pay provides the following services:

• A digital wallet for holding and managing USDC on the BNB Chain (BEP-20)
• QR code-based payments to merchants, with settlement in Papua New Guinea Kina (PGK)
• Card loading (loading fiat value via debit/credit card)
• Withdrawal of funds to bank accounts or cards via Visa Direct
• Crypto-to-fiat conversion and fiat-to-crypto conversion
• International transfers within the Pacific region

T4G Pay acts as a payment intermediary. We do not hold custody of your web3 wallet private keys. You are solely responsible for the security of your connected wallet.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

• Provide accurate and truthful information during registration
• Keep your password secure and not share it with anyone
• Notify us immediately at info@howarigtraders.com.pg if you suspect unauthorised access
• Accept responsibility for all activity that occurs under your account

Howarig Traders reserves the right to suspend or terminate accounts that violate these Terms or are suspected of fraudulent activity.

5. Payments and Transactions

All transactions on T4G Pay are processed on the BNB Chain blockchain and are irreversible once confirmed on-chain. You acknowledge that:

• Blockchain transactions cannot be reversed or cancelled once submitted
• Exchange rates between USDC and PGK are indicative and may vary at the time of settlement
• T4G Pay verifies transactions using BscScan and is not responsible for network delays or congestion
• Merchant settlement timelines depend on the bank Internet Payment Gateway (IPG) and may vary
• You are responsible for sending the correct amount to the correct address

6. Fees

T4G Pay may charge fees for certain services, including but not limited to card loading (processing fee), withdrawals, and currency conversion. All applicable fees will be clearly displayed to you before you confirm a transaction. We reserve the right to update our fee schedule with reasonable notice.

7. Prohibited Activities

You must not use T4G Pay for:

• Money laundering, fraud, or any illegal financial activity
• Funding terrorism or sanctioned activities
• Purchasing illegal goods or services
• Creating multiple accounts to abuse promotions or limits
• Attempting to reverse-engineer, hack, or disrupt the platform
• Providing false identity or KYC information

Violation of these prohibitions may result in immediate account suspension, reporting to relevant authorities, and legal action.

8. Disclaimer and Limitation of Liability

T4G Pay is provided "as is" without warranties of any kind. To the maximum extent permitted by Papua New Guinea law, Howarig Traders shall not be liable for:

• Loss of funds due to market volatility in cryptocurrency values
• Service interruptions caused by third-party networks, banks, or blockchain congestion
• Unauthorised access to your account resulting from your failure to protect your credentials
• Indirect, incidental, or consequential damages arising from use of the platform

Our total liability to you in any circumstance shall not exceed the value of the last transaction processed on your account.

9. Termination

We may suspend or terminate your account at any time for violation of these Terms, suspected fraud, or legal compliance requirements. You may close your account at any time by contacting us at info@howarigtraders.com.pg. Upon termination, any pending transactions will be completed or reversed at our discretion in accordance with applicable law.

10. Governing Law

These Terms are governed by the laws of Papua New Guinea. Any disputes arising from your use of T4G Pay shall be subject to the exclusive jurisdiction of the courts of Papua New Guinea. We encourage users to contact us first to resolve disputes informally before initiating legal proceedings.

We reserve the right to update these Terms at any time. Continued use of T4G Pay after changes are posted constitutes your acceptance of the updated Terms.

Part B — Privacy Policy

Howarig Traders (HT) is committed to protecting your personal information. This Privacy Policy explains how we collect, use, store, and protect your data when you use T4G Pay.

1. Information We Collect

We collect the following information when you register and use T4G Pay:

• Identity data: First name, last name, email address, phone number, country of residence
• Account data: Password (stored as a secure hash), account creation date, last login
• Transaction data: Payment amounts, merchant details, blockchain transaction hashes, wallet addresses
• KYC data: Government-issued ID documents (where required for identity verification)
• Device and usage data: IP address, browser type, pages visited, time spent on the platform

2. How We Use Your Information

We use your information to:

• Create and manage your T4G Pay account
• Process payments and verify blockchain transactions
• Comply with Anti-Money Laundering (AML) and Know Your Customer (KYC) obligations
• Detect and prevent fraud and unauthorised activity
• Communicate with you about your account, transactions, and service updates
• Improve our platform and develop new features
• Meet legal and regulatory requirements under Papua New Guinea law

We do not sell your personal data to third parties for marketing purposes.

3. Sharing of Information

We may share your information with:

• Banking partners: BSP, Kina Bank, or other licensed financial institutions for fiat settlement
• Payment processors: Visa Direct, card payment gateways, for processing withdrawals and loads
• Blockchain networks: Transaction data is publicly visible on BscScan as part of the BNB Chain
• Regulatory authorities: Bank of Papua New Guinea (BPNG), law enforcement, or courts when required by law
• Service providers: Hosting, email, and security providers who process data on our behalf under strict confidentiality agreements

4. Data Security

We take reasonable technical and organisational measures to protect your personal data, including:

• HTTPS encryption for all data transmitted to and from T4G Pay
• Passwords stored using bcrypt hashing — we never store plain-text passwords
• Session-based authentication with automatic timeout after 60 minutes of inactivity
• Restricted access to your data within our organisation on a need-to-know basis

5. Cookies

T4G Pay uses session cookies to keep you logged in and to maintain your preferences. We do not use advertising or tracking cookies. You may disable cookies in your browser settings, but this may affect the functionality of the platform.

6. Your Rights

You have the right to:

• Access the personal data we hold about you
• Request correction of inaccurate data
• Request deletion of your account and associated data (subject to legal retention requirements)
• Withdraw consent for optional data processing at any time
